1. GENERAL

1.1 These Terms and Conditions govern all yacht charter bookings, services, reservations, and related transactions arranged under the brand The Yacht Club Singapore (“TYC Singapore”).

1.2 The brand The Yacht Club Singapore is operated by the legal entity TYC Pte Ltd (“TYC”, “we”, “us”, “our”). All references in these Terms to “The Yacht Club Singapore”, “TYC”, “we”, “us”, or “our” shall be construed as references to TYC Pte Ltd.

1.3 By making any booking, confirming a reservation, or making any payment (whether deposit or full payment), the Charterer acknowledges and agrees to be legally bound by these Terms and Conditions.

1.4 Payment constitutes conclusive evidence of acceptance of these Terms and Conditions, irrespective of whether the Charterer has read them in full.

2. DEFINITIONS

  • Charterer: The person or entity making the booking, including all guests, invitees, and passengers.

  • Charter Date: The scheduled date and time of the yacht charter.

  • Charter Fees: All amounts payable for the charter, excluding optional add-ons unless stated otherwise.

3. ROLE OF THE YACHT CLUB

3.1 The Yacht Club Singapore, operated by TYC Pte Ltd, acts solely as a booking facilitator and coordinator unless otherwise stated in writing.

3.2 Yachts, captains, crew, and related services may be provided by independent third-party operators. TYC does not own, manage, control, navigate, or operate these yachts.

3.3 TYC shall not be liable for the acts, omissions, or negligence of third-party yacht operators to the fullest extent permitted by Singapore law.

4. YACHT INFORMATION & PHOTOGRAPHS

4.1 All yacht descriptions, specifications, layouts, capacities, amenities, photographs, videos, and promotional materials (“Yacht Information”) are provided based on information available to TYC and updated to the best of TYC’s and its staff’s reasonable knowledge and belief at the time of publication.

4.2 While reasonable care is taken, no warranty or guarantee is given that such information is complete, current, or free from inaccuracies or changes due to maintenance, owner decisions, or operational reasons.

5. VIEWINGS & CUSTOMER VERIFICATION

5.1 Pre-Payment Viewing (Recommended)

Charterers are strongly advised to conduct a physical viewing prior to payment in order to independently verify the yacht’s condition, layout, facilities, and suitability.

5.2 Post-Payment Viewing

Any viewing conducted after payment is at the Charterer’s sole risk and:

  • Does not create a conditional booking;

  • Does not suspend, reset, or extend cancellation periods; and

  • Does not entitle the Charterer to any refund, reduction, or renegotiation.

5.3 No Liability Where No Viewing Is Conducted

Where the Charterer elects not to conduct a pre-payment viewing, TYC assumes no responsibility for dissatisfaction relating to yacht condition, appearance, or suitability.

6. CONDITION OF YACHT

6.1 Unless expressly stated otherwise in writing, no representation or warranty is given regarding cosmetic condition, wear and tear, furnishings, or non-essential amenities.

6.2 Normal wear and operational variations shall not constitute defects or grounds for complaint.

7. BOOKINGS & PAYMENT

7.1 Upon receipt of any payment (whether deposit or full payment), the booking becomes immediately binding.

7.2 The cancellation period shall commence from the date and time payment is received, irrespective of whether a viewing is conducted.

8. CANCELLATION POLICY & LIQUIDATED DAMAGES

8.1 The Charterer acknowledges that cancellation of a confirmed booking results in losses to TYC that are difficult to precisely quantify, including loss of alternative bookings, administrative costs, crew scheduling, marina arrangements, and operational commitments.

8.2 Accordingly, the following cancellation charges are agreed liquidated damages, representing a genuine pre-estimate of loss and not a penalty:

8.3 TYC may retain all sums paid and recover any outstanding balance as a debt due.

8.4 Post-Payment Viewing Within 14 Days

Where a post-payment viewing is conducted within fourteen (14) days of the Charter Date and the Charterer subsequently cancels, 100% of Charter Fees shall be forfeited.

9. LATE ARRIVAL & NO-SHOW

9.1 Late arrival does not extend charter time.

9.2 Failure to arrive within the scheduled boarding window constitutes a no-show, and 100% of Charter Fees shall be forfeited.

10. WEATHER & FORCE MAJEURE

10.1 Charters proceed rain or shine unless deemed unsafe by the yacht captain, port authorities, or TYC.

10.2 TYC shall not be liable for cancellation, delay, or modification due to events beyond its reasonable control, including weather conditions, mechanical issues, port restrictions, government actions, or force majeure events.

10.3 No refund shall be payable unless expressly granted at TYC’s discretion.

11. ASSUMPTION OF RISK

The Charterer acknowledges that yacht charters involve inherent risks. The Charterer voluntarily assumes all risks for themselves and their guests, including risks of injury, death, or property loss.

12. LIMITATION OF LIABILITY

12.1 To the fullest extent permitted by Singapore law, TYC shall not be liable for any indirect, incidental, consequential, or economic loss, including loss of enjoyment or profits.

12.2 TYC’s total liability, if any, shall be strictly limited to the Charter Fees actually paid for the affected booking.

13. INDEMNITY

The Charterer agrees to indemnify and hold harmless TYC, its directors, employees, agents, and partners against all claims, losses, damages, liabilities, and legal costs arising from:

  • Acts or omissions of the Charterer or guests;

  • Injury, death, or property damage;

  • Breach of these Terms; or

  • Illegal or unsafe conduct.

14. THIRD-PARTY SERVICES

Food, beverages, entertainment, decorations, and other add-ons may be provided by third parties. TYC assumes no responsibility for their performance, quality, or safety.

15. PERSONAL DATA

The Charterer consents to the collection, use, and disclosure of personal data in accordance with Singapore’s Personal Data Protection Act for booking administration, regulatory compliance, and marketing purposes.

16. RIGHT TO REFUSE OR TERMINATE

TYC reserves the right to refuse service or terminate a charter without refund if conduct is unsafe, unlawful, or inappropriate.

17. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Singapore. The courts of Singapore shall have exclusive jurisdiction.

18. ENTIRE AGREEMENT & SEVERABILITY

These Terms constitute the entire agreement between the parties. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
